现在的情况是,我问了几个lawyer regarding the independent legal advice,听了我的故事后(即我当初不得已答应的settlement), 他们都不肯给我witness certificate. 我是不是可以 1.问现律师他要求certificate的法律依据是什么? 2.我该不该告诉他没有律师肯给我certificate?如果我这么说了他一定知道我在那些律师处说的故事就是他怎么不好,所以他更会要independent legal advice来保护他免得我将来起诉他.3.主要是我现在不敢去律师协会投诉,因为Long Term Disability的subrogation 还未解决. 因为我不知道这个律师知道我去告状会不会在我的LTD subrogation上使坏(比如把我的赔偿很大部分去付给LTD公司). 我和LTD的case manager联系了,她说她会和公司的legal department联系,大概要一星期后才会告诉我legal department怎么说. 好拖啊,这儿的高手有什么好建议吗?
如果没有subrogation这事, 我都想email律师: I've consulted a couple of lawyers, they all think it's unusual that an ILA is required at this stage, and there is no legal foundation for it unless the current lawyer has discovered that he has made some mistakes/omissions that may be damaging the client during the process thus requiring an ILA to protect himself. As obviously I fully understand the content of the release, and it's my free will to sign the release. Therefore, they refuse to issue me a certificate as they are not aware of the whole situation. 但是我不知道这样写行不行,会造成啥后果.
